These general terms and conditions apply to all agreements entered into with VERKEERS OPLEIDING CENTRUM, as well as to anyone taking lessons or receiving other services from this driving school. This document outlines all the agreements that must be adhered to by both the Driving School and the students.
THE DRIVING SCHOOL MUST ADHERE TO THE FOLLOWING AGREEMENTS:
ARTICLE 1
1.1 The student receives practical lessons from a driving instructor who meets the requirements of the Road Traffic Instruction Act (WRM). The instructor must possess a valid instructor certificate.
1.2 The theory or practical exam will be reserved by the Driving School within two weeks after you have paid the exam fees (if possible).
1.3 The student will generally take the driving exam in the car used for lessons. However, in case of force majeure, the student may take the exam in a substitute car.
1.4 The driving lesson must be fully utilized for the student. Therefore, it is not the intention for the instructor to engage in other activities unrelated to the lesson during lesson time, such as grocery shopping.
1.5 The Driving School has taken out good business insurance in case something happens for which it is liable to you.
1.6 If lessons cannot proceed due to the instructor’s illness or an accident, weather, or traffic conditions, the student will be informed in a timely manner, and a new appointment will be made or a substitute instructor will be assigned. In such cases, the student cannot claim any refund and/or compensation.
THE CANDIDATE / STUDENT MUST ADHERE TO THE FOLLOWING AGREEMENTS:
ARTICLE 2
2.1 To take driving lessons, you must be at least 16.5 years old. To take motorcycle lessons, you must be 18 years old and possess a B driver’s license or A theory certificate. For moped lessons, you must be 16 years old. The student must always have a valid ID during lessons.
2.1a The candidate may not share lesson content or links with others without written permission from Al-Andalos Driving School.
2.2 The student must ensure they are on time and ready at the agreed location for the driving lesson. If the student is slightly late, the instructor will always wait 10 minutes at the agreed location. If you are still not there, the Driving School has the right to charge 100% of the lesson fee.
2.3 The student may cancel or reschedule a driving lesson. However, this must be done at least 48 hours in advance, otherwise the Driving School has the right to charge 100% of the lesson fee due to reserved time.
2.3.1 The candidate may cancel or reschedule courses. However, this must be reported at least 48 hours in advance, otherwise the Driving School has the right to charge 100% of the course fee due to reserved space.
2.4 A late-canceled lesson will not be charged to the student if there is an urgent reason. Urgent reasons include: the death of a close family member, funeral, and emergency hospitalization. Non-urgent reasons include: illness, hospitalization that you know about in advance but forget to mention, schedule changes, or vacation.
2.5 The student provides all necessary information about their medical and/or psychological condition, medication, alcohol, and/or drug use truthfully to the Driving School. Self-declarations filled out at the CBR that are not filled in truthfully are at the student’s and parental risk.
2.6 If the student conceals anything mentioned in 2.5, the Driving School has the right to terminate the lessons (lesson agreement) immediately without any refund of lesson fees.
2.7 In case of damage caused by situations mentioned in 2.5, the Driving School has the right to recover these costs from the student.
THE FOLLOWING TERMS APPLY TO PAYMENT METHODS:
ARTICLE 3
3.1 Payments can be made both in cash and via card to the instructor and must be paid before each lesson.
3.2 For payments regarding lesson packages, payment deadlines must be met no later than 2 weeks after the due date; otherwise, lessons will be suspended.
3.3 If the student fails to pay on time, the Driving School follows the procedure below:
a. If there is a payment backlog, you will initially receive a reminder invoice. If this is also ignored, you will receive a payment demand 8 days after the reminder, incurring demand costs (minimum €10). If possible, the Driving School will contact the student by phone.
b. The Driving School may start charging interest on the owed amount after 14 days have passed since the invoice date. This interest is the legal interest plus 2% or 0% annually.
3.4 If the student still does not pay, the Driving School will involve a collection agency, which incurs additional costs that the student must bear.
3.5 If you have purchased a package and obtain your driver’s license while not having fully utilized the package, you are entitled to a refund: the unused hours will be credited at the package hourly rate.
3.6 Lesson packages purchased will not be credited if the training is stopped.
